New Jersey: Action Alert: Protect the Open Public Records Act

CWAers are going all out to put a stop to a dangerous bill (S2930/A4045) that would gut the Open Public Records Act (OPRA) and severely undermine our ability to access public records. The bill was just passed by the NJ State legislature and would make sweeping changes that would have a huge impact on our union, as well as our communities throughout New Jersey, including:

  • Guts the enforcement mechanism for OPRA, making it harder to get legal representation to challenge improper OPRA decisions.
  • Allows government agencies to sue requestors for seeking records "with the intent to substantially impair the performance of government function,” which could allow government agencies to retaliate and to stop requests.
  • Prohibits sending a request to multiple agencies and allows agencies to deny a request for this reason, creating a new and unnecessary hurdle to access public records.
